ADVISORY - US Federal Elections Records Retention
5/17/2024 - This is the letter sent to all auditors in South Dakota, advising them to make sure that the save ballot images is turned on.
Let's Prevent The Ballot Images Potential Federal Violation
We have a Federal Election on the Democrat ticket in South Dakota, and in all Federal Elections we must follow 52 USC 70201 to make sure we can preserve all records for 22 months. Having the Save Ballot Images setting turned to NO IMAGES, is a direct violation of 52 US 70202 in preventing the saving of the images to the thumb drive during backups is a method of concealment and altering of the record being properly retained as per the spirit of the Federal Law. In talking with Leah Anderson of Minnehaha County she has made it clear to ES&S she wants the images saved and retained. We will be making a recommendation to the SD State Board of Elections to keep them on.
Records Retention Statement form DOJ Civil Rights Division. Yes we need to protect the voters from intimidation, but we must still maintain the records for Federal investigators.
Print each version on one side of the same sheet to be in compliance with the law.
